Disputes
What should you do if you dispute a posting by another person? First,
take a moment to assess the actual affect it will have. Regular
Bar visitors are accustomed to the flamers and their ways. A posting
that is hostile or defamatory is more likely to reflect badly on
its author than its intended target. If you feel it deserves a reply,
then by all means defend your position. A tactfully crafted response
will speak volumes.
Can you delete a message you don't like? Generally, no. Only the
author can delete his messages. In rare instances where the Bar
terms of use are clearly violated (such as the author's email address
is no longer valid) it may be possible to have the message removed.
Please review the disclaimer above.
How can you determine the identity of a poster? It may be difficult,
and in the end could require a court order if the user's ISP doesn't
willingly provide the information. The first step is to get the
IP address from the message. This is the set of four numbers separated
by dots (ex: 123.45.67.89) Use this form to resolve the IP to a
host:IP Address: Lookup
The next step is to get the domain name from the host. If the IP
lookup returns something like a1.transfer.ppp.xyz.com then the domain
can be determined as xyz.com. This is the domain name of the service
provider used by the message poster. You may be able to browse directly
to www.xyz.com to locate contact information or you may have to
investigate further.
The owner information for domain names is publicly available from
the company that is the registrar for the domain. Network Solutions
is the predominant registrar for .com, .net, and .org so you might
as well look there first. If no information for the domain is found,
proceed to the central registry of names, InterNIC. A lookup there
will tell you the registrar for the domain, which you can then use
to complete the search.
Use this form to access the WhoIs services of various registrars.
Enter the domain name (ex: xyz.com) and select the registry database:Domain
name: Lookup When contacting the ISP, explain your situation and
provide a direct URL to the offending message. The URL for each
Bar message is indicated at the bottom of the page where it is displayed.
Most dialup connections are dynamically addressed, meaning they
change each time a user connects with his ISP, so it can be helpful
to point out the exact time the message was posted.
You may not be able to get the ISP to release the user's name without
an order from the court. Even if you do not intend to pursue it
that far, it's a good idea to at least make a formal complaint with
the ISP so that they can deal with the troublemaker on their own.
They may even cancel the user's account for violating their acceptable
use policy.
